Where you click on links directly to an affiliate website, like SOMA Breath, any personally identifiable information you provide to the affiliate will not be disclosed to Tim Snell, unless otherwise disclosed.

We may disclose your personal information to any of our employees, officers, insurers, professional advisers, agents, suppliers, or subcontractors as reasonably necessary for the purposes set out in this policy.

We may disclose your personal information to any member of our group of companies (this means our subsidiaries, our ultimate holding company and all its subsidiaries) as reasonably necessary for the purposes set out in this policy.

 

At times we engage in training and continuing education pursuing and/or maintaining ICF (International Coach Federation) Credentials. That process requires the names and contact information of all Clients for possible verification by ICF. 

 

Within your agreement with us, we will ask you to agree to have only your name, contact information and start and end dates of coaching shared with ICF staff members and/or other parties involved in this process for the sole and necessary purpose of verifying the coaching relationship, no personal notes will be shared. You have a choice to accept or decline this request.

We may disclose your personal information:

  1. to the extent that we are required to do so by law;

  2. in connection with any ongoing or prospective legal proceedings;

  3. in order to establish, exercise, or defend our legal rights (including providing information to others for the purposes of fraud prevention and reducing credit risk);

  4. to the purchaser (or prospective purchaser) of any business or asset that we are (or are contemplating) selling; and

  5. to any person who we reasonably believe may apply to a court or other competent authority for disclosure of that personal information where, in our reasonable opinion, such court or authority would be reasonably likely to order disclosure of that personal information.

 

Except as provided in this policy, we will not provide your personal information to third parties.

Confidentiality within Agreements
This coaching and consultancy relationship, as well as all information (documented or verbal) that Clients (you) share with the us as part of this relationship, is bound by the principles of confidentiality set forth in the ICF Code of Ethics and the APMP Code of Ethics.

However, please be aware that our relationship is not considered a legally confidential relationship (like the medical and legal professions) and thus communications are not subject to the protection of any legally recognized privilege.

We agree not to disclose any information pertaining to the you without the your written consent. We will not disclose the your name as a reference without the your consent.

Confidential Information does not include information that:
(a) was in the Coach’s possession prior to its being furnished by you;
(b) is generally known to the public or in your industry;
(c) is obtained by the Coach from a third party, without breach of any obligation to you;
(d) is independently developed by us without use of or reference to your confidential information; or
(e) we are required by statute, lawfully issued subpoena, or by court order to disclose;
(f) is disclosed to us and as a result of such disclosure to us reasonably believes there to be an imminent or likely risk of danger or harm to you or others; and
(g) involves illegal activity.

You also acknowledge your continuing obligation to raise any confidentiality questions or concerns with us in a timely manner.

 

F. International data transfers

  1. Information that we collect may be stored, processed in, and transferred between any of the countries in which we operate in order to enable us to use the information in accordance with this policy.

  2. Information that we collect may be transferred to the following countries which do not have data protection laws equivalent to those in force in the European Economic Area: the United States of America, Russia, Japan, China, and India.

  3. Personal information that you publish on our website or submit for publication on our website may be available, via the internet, around the world. We cannot prevent the use or misuse of such information by others.

  4. You expressly agree to the transfers of personal information described in this Section F.

 

G. Retaining personal information

  1. This Section G sets out our data retention policies and procedure, which are designed to help ensure that we comply with our legal obligations regarding the retention and deletion of personal information.

  2. Personal information that we process for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes.

  3. Without prejudice to article G-2, we will usually delete personal data falling within the categories set out below at the date/time set out below:

    1. personal data type will be deleted after 5 years;

  4. Notwithstanding the other provisions of this Section G, we will retain documents (including electronic documents) containing personal data:

    1. to the extent that we are required to do so by law;

    2. if we believe that the documents may be relevant to any ongoing or prospective legal proceedings; and
